SEEK COMMERCIAL – BLACKBERRY® AND FREE ADVERTISING COMPETITION
TERMS AND CONDITIONS
1.
The Promoter

Terms of Entry
(a) The competition is open to all Australian residents.
(b) Entry to the competition is open to eligible delegates that attend the National Franchise & Small Business Convention ("
Expo") at the Sydney Exhibition and Convention Centre during the period 16 to 18 October 2008 inclusive who while at the Expo deposit (by 5.00 pm AEST on any of the relevant dates) their business card (with their contact details) into a box which will be at the SEEK Commercial stand at the Expo.
(c) Multiple entries by eligible entrants will not be accepted.
(d) The Promoter reserves the right to determine as to whether an entry will be accepted.
(e) The Promoter takes no responsibility for entries (business cards) that are lost, stolen, illegible or damaged however caused.
(f) Submitting an entry constitutes acceptance of these terms and conditions.
3.
Who may enter
(a) The competition is open to all Australian permanent residents that attend the Expo.
(b) The competition is not open to:
(i) employees of the Promoter;
(ii) parties to whom the Promoter has contracted work in relation to this competition;
(iii) parties who otherwise are directly involved with this competition;
and
(iv) any immediate family member of the abovementioned parties.
4.
Selecting the winners
(a) The competition winner will be selected on 22 October 2008 at 5.00 pm at 541 St Kilda Road, Melbourne, Victoria, 3004 by one or more representatives of the Promoter.
(b) The winner's name will be manually drawn from a hat by one or more of the Promoter's representatives.
(c) The winner will be notified by telephone by 1 November 2008. If the winner cannot be contacted by the Promoter or one its representatives, the winner may forfeit the prizes and the Promoter may award the prizes to another entrant.
(d) If the Promoter has been unable to notify and award the prize to the first drawn eligible entrant by 24 February 2009, the Promoter will conduct a further draw on 25 February 2009 at 541 St Kilda Road, Melbourne, Victoria, 3004 through the same process identified above.
5.
Prize
(a) The prizes to be awarded are:
(i) a Blackberry® Bold™ 9000+ with a recommended retail price of $879 as at August 2008;
and
(ii) free advertising on SEEK Commercial's website located at
www.seekcommercial.com.au ("Website") valued at $2,085 excluding GST as at August 2008 ("Advertising Prize").
(b) While the Blackberry® Bold™ 9000+ prize is transferable (although it cannot be exchanged for any other valuable consideration – in particular money) the Advertising Prize awarded cannot be transferred. Any attempt to sell or transfer the Advertising Prize for any valuable consideration, will result in the prize being cancelled by the Promoter.
The Promoter reserves the ultimate discretion on these matters.
(c) The Advertising Prize includes a profile page of the winner in the "Franchise Directory" on the Website and up to 20 advertisements per month over a 3 month period on the Website.
(d) Any unused advertisements forming part of the Advertising Prize in any given month (over the 3 consecutive month period over which the Advertising Prize must be used) roll over into any subsequent month, although any unused advertisements left at the end of the 3 month period within which the advertisements are to be placed will expire.
(e) Each advertisement forming part of the Advertising Prize may be posted on the Website up to 30 days by the winner or until the advertisement is removed by the winner, whichever date occurs first.
(f) The winner must place their first advertisement forming part of the Advertising Prize within 6 months of the date the Advertising Prize is awarded, failing which, the Advertising Prize will expire.
(g) The Advertising Prize does not include brand building products available to be purchased from the Promoter such as home page tiles and banners available for use on the Website.
(h) If the winner of the prize is an existing client that already advertises on the Website and has previously entered into a subscription agreement with the Promoter for its advertising requirements on the Website, the Promoter will suspend its invoicing of the winner to the total value of the Advertising Prize, although all other terms and conditions of the Advertising Prize will apply to this winner.
6. Publicity
(a) The Promoter will publish the prize winner's name on its website (www.seek.com.au) on 4 March 2009.
(b) Entry into the competition constitutes permission for the Promoter to use the winner's name for advertising and competition purposes including but not limited to publication of the winner's name on its website without compensation, unless otherwise prohibited by law.
7.
Discontinuation of the Competition or Disqualification of an Entrant
(a) The Promoter reserves the right to discontinue the competition at any time and at its sole discretion may cancel the competition without the need to provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right in its sole discretion, to disqualify any individual for acting in violation of any of these terms and conditions.
8.
Exclusion of Liability
(a) The Promoter makes no representation nor provides any warranties as to the quality/ suitability/ merchantability of the prizes offered.
(b) The Promoter is not responsible for any losses associated with any change to the value of any prizes.
(c) To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter or its servants or agents, in connection with the supply of the prizes awarded to the prize winner.
(d) The Promoter's decision on all matters pertaining to this competition will be final.
(e) The Promoter is under no obligation to provide reasons for any of its decisions.
(f) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants or their representatives in matters relating to the competition.
